Terms of Service

These Terms of Service are entered into by and between https://sk5data.com/ (hereinafter "we", "us", or "our") and the user (hereinafter "you") who registers, accesses, or uses sk5data.com and related proxy services, console, and API (hereinafter the "Services").

Please read these Terms carefully before registering or purchasing. When you click to confirm acceptance on the relevant page or actually use the Services, these Terms shall become legally binding on both parties. If you use the Services on behalf of a company or other organization, you represent and warrant that you have been fully authorized by such company or organization and have the right to accept these Terms on its behalf.

1. Description of Services

We provide dynamic residential proxies, unlimited residential proxies, long-lasting static ISP, and related management functions.

The price, validity period, billing method, region, protocol, bandwidth, ports, concurrency, and other specifications of each plan are subject to the order and product description displayed and confirmed at the time of your purchase.

Proxy services provide network connectivity. We do not guarantee that all target websites will be accessible, nor do we guarantee that third-party accounts will not be restricted, that data collection will succeed, or that any other specific business result will be achieved. These Terms do not reduce our liability for the service specifications we have promised.

2. Accounts and Security

You shall provide true and valid registration information. You represent and warrant that you are at least 18 years old and have full legal capacity required to enter into this agreement.

You shall properly keep your account password, proxy credentials, and API keys, and manage the sub-accounts and personnel you authorize to use them. If you discover credential leakage or abnormal use, please promptly change the credentials and contact us.

Without our written permission, you may not transfer accounts or resell the Services; except for reseller services expressly permitted.

3. Usage Restrictions and Compliance Requirements

You shall comply with applicable laws and ensure that your access, collection, and use of data have the necessary permissions or legal basis. You may not use the Services to engage in the following:

  • Infrastructure attacks: carrying out intrusions, account theft, unauthorized access, or information theft; spreading malware, conducting distributed denial-of-service (DDoS) attacks, or interfering with the normal operation of networks.
  • Fraud and illegal activities: engaging in fraud, phishing, spam, advertising click or conversion fraud; spreading illegal content or engaging in other illegal activities.
  • Infringement of rights: infringing others' privacy, intellectual property, or other lawful rights and interests; scraping sensitive personal data without authorization.
  • Bypassing restrictions: bypassing the authentication, billing, bandwidth, port, or concurrency limits of the Services.
  • High-risk financial operations: using the Services to attack, interfere with, or gain unauthorized access to financial, banking, cryptocurrency exchange, and other highly sensitive systems.

If specific targets, ports, protocols, or uses are restricted, we will disclose this in the product description or usage rules before purchase.

4. Orders, Refunds, and Billing

In the event of duplicate charges, undelivered resources, or services failing to meet promised specifications, please submit the order information via support@sk5data.com. We will verify the situation and provide remedies such as repair, reissue, or extension based on the specific issue.

Refund conditions, application periods, and processing methods are set out in the [Refund Policy link] displayed before purchase. Services normally provided and used will be handled in accordance with the refund policy; refunds or other user rights under applicable law are not affected. Once our Services have been delivered and are in normal use, in principle, refunds without cause are not supported, and all payments are final; however, we will strictly perform the above service guarantee obligations.

If data processing is involved, both parties shall comply with applicable data protection laws.

5. Privacy and Intellectual Property

We are not liable for indirect losses, incidental losses, or punitive damages that may be excluded under applicable law. No limitation of liability excludes any liability that cannot be excluded or limited by law, nor does it affect users' mandatory rights under law.

Updates will not retroactively diminish the service rights of orders already paid for.
